Terms and Conditions
1. Project Suspension or Termination
If the client suspends or terminates the project at any stage of this agreement, the designer will be compensated for the work completed, as outlined in the contract. No refunds will be issued once any work product has been produced and a partial payment has been made. Any refund requests must be submitted in writing and will be reviewed in accordance with the terms of this contract.
2. Payment Adherence
The designer will not initiate or continue work if the client fails to adhere to the agreed-upon payment schedule.
3. Revisions and Additional Work
Any client-initiated modifications after design approval will incur an additional charge of $75.00 per hour, payable upon each delivery of the revised design.
4. Contractor Delays and Responsibilities
The designer is not responsible for, nor will compensation be withheld due to, contractor delays, nonperformance, or errors.
5. Additional Services and Costs
The client acknowledges that the compensation outlined in this agreement covers only direct labor costs. Additional expenses may arise throughout the project. If the client approves an initial design but later requests significant modifications resulting in additional time, services, or costs for the designer—whether due to delays by the client or contractor, insolvency, or unforeseen events such as fire or damage—the client agrees to compensate the designer accordingly, regardless of whether construction proceeds.
6. Reimbursable Expenses
The client is responsible for reimbursing the designer for additional costs, including but not limited to:
Engineering reproductions
Certified documents
Postage and shipping fees
Film processing and development
Scale architectural models
Construction estimating
Consultation fees and similar project-related expenses
Alternatively, these costs may be designated as the owner's responsibility, as specified in the agreement.
